Our Terms & Conditions
All Students must agree to the following Terms and Conditions to be able to book their lessons and confirm they will complete a Contact / Medical form before the activity can take place.
Please read through and make sure you’re happy with the following:
The terms and conditions of all agreements made shall be subject to, and governed by, English law.
All bookings are made with Ben Witts, North Devon Kitesurfing.
All booking will be confirmed by email, if you haven’t received your booking confirmation email please let us know immediately as you are not actually booked.
Any agreed booking will be cancelled after 24 hours if the agreed payment isn’t received.
We accept payment by Paypal (gift only), bank transfer or by cash before start of lesson (no cash point on site).
All decisions regarding the running or cancellation of any course are only at the discretion of North Devon Kitesurfing
The courses we offer are weather & tide dependent.
If bad weather affects a booking it will be rescheduled at no cost to yourself, you will be able to book alternative dates on which to return and complete your training, it is not possible to refund the money of the participant.
In the event of a course being unfinished due to adverse weather or stopped for any other reason by the Instructor, you will be able to book alternative dates on which to return and complete your training, it is not possible to refund the money of the participant.
In the event of no wind, you will be able to book alternative dates on which to return and complete your training, it is not possible to refund the money of the participant.
North Devon Kitesurfing reserves the right to cancel any course for any reason at any time before the start of the course. In this situation participants will be offered alternative dates or a full refund.
Cancellation due to situations out of the control North Devon Kitesurfing such as wars, acts of God, may be subject to the loss of money paid where a refund is not possible.
In the event of any cancellation, North Devon Kitesurfing will not be held liable for the cost of lost insurance premiums, travel expenses, pre-booked accommodation costs or any other costs incurred.
Any fees paid will be refunded if the participant makes a cancellation more than 30 days before the course is to commence. Within 30 days of the course commencement fees paid will not be refunded.
Booked dates can only be changed giving 14 days notice by email. Within 14 days of the course commencement it will be considered as a failure to attend / a cancellation and fees paid will not be refunded.
A failure to attend a booked course will be considered a cancellation and will be subjected to the conditions above.
LIABILITY AND INSURANCE
Kitesurfing is a potentially dangerous activity. All participants must be aware of this and accept the risks associated with this activity.
Injury arising from kitesurfing or associated activities can only be accepted if caused by negligence on the part of North Devon Kitesurfing.
North Devon Kitesurfing is under no liability whatsoever in respect of loss or damage to clients property or equipment, however caused.
HEALTH AND SAFETY CONSIDERATIONS
Due to the strenuous nature of kitesurfing, all participants should be physically fit.
Anyone with a medical condition must seek medical advice before considering participating.
North Devon Kitesurfing must be informed of any medical conditions (asthma, epilepsy, deafness etc.) or any other special needs of any/all participants.
North Devon Kitesurfing reserves the right to refuse a person who is at a high risk to him/herself or other participants on the course.
All participants must be able to swim 25m and be confident swimming in open water.
All participants must be aged 16 or over.
Course participants will not be permitted to consume alcohol or drugs prior to or during kitesurfing courses.
North Devon Kitesurfing reserves the right to refuse participation to anyone considered to be under the influence of alcohol or drugs.
North Devon Kitesurfing may require any participant to leave the course if that person acts in any such manner as to endanger him/herself or any other participant.
We ask you to leave plenty of time to get to the venue. Many of the courses and experiences we offer require a safety briefing it is essential that the participant attends the briefing otherwise they will not be able to participate.
EQUIPMENT AND CLOTHING
Damage or loss to North Devon Kitesurfing equipment caused by negligence, malicious acts or carelessness must be paid for at the time at current replacement value.
